1. Introduction

These Terms of Use (“Terms”) govern the access to and use of the AguAqui mobile application (“Application” or “App”), made available by:

By downloading, installing, accessing, or using the AguAqui Application, the user fully accepts these Terms.

If the user does not agree with these Terms, they must immediately cease using the Application.

2. Purpose of the Application

The AguAqui Application allows users to:

  • view products and services made available by AguAqui;
  • place orders for water and other products;
  • manage deliveries;
  • track orders;
  • contact customer support;
  • receive notifications related to orders and services;
  • access their customer account.

Purchases and deliveries made through the Application are also subject to the Terms and Conditions of Sale and Delivery of AguAqui.

3. Eligibility

By using the Application, the user declares that:

  • is at least 18 years of age;
  • has the legal capacity to enter into contracts;
  • provides true, complete, and up-to-date information;
  • will use the Application only for lawful and personal purposes.

4. User Account

To access certain features of the Application, it may be necessary to create an account.

The user is responsible for:

  • maintaining the confidentiality of access credentials;
  • all activities carried out through their account;
  • updating their data whenever necessary.

AguAqui reserves the right to suspend or terminate accounts in the event of abusive, fraudulent use or violation of these Terms.

5. Permitted Use

The user undertakes not to:

  • use the Application for illegal purposes;
  • interfere with the functioning of the Application;
  • attempt to gain unauthorized access to systems or accounts;
  • introduce viruses, malware, or malicious code;
  • use bots, automated scripts, or scraping mechanisms;
  • copy, modify, or distribute Application content without authorization;
  • use the Application in any way that may harm AguAqui or third parties.

6. Application Availability

AguAqui strives to ensure the continuous operation of the Application, but does not guarantee that:

  • the Application will be available without interruptions;
  • the service will be free of errors;
  • the Application will function on all devices or operating systems;
  • technical failures will not occur.

AguAqui may temporarily suspend access for maintenance, updates, or technical reasons.

7. Updates and Changes

AguAqui may:

  • update the Application;
  • modify functionalities;
  • add or remove services;
  • change the interface or content;
  • partially or fully discontinue the Application.

Some functionalities may depend on the installation of the latest version of the Application.

8. Push Notifications

By using the Application, the user may receive push notifications related to:

  • order status;
  • deliveries;
  • promotions;
  • campaigns;
  • App updates;
  • service communications.

Notifications can be disabled in the mobile device settings.

9. Intellectual Property

All content of the Application, including:

  • AguAqui brand;
  • logos;
  • texts;
  • images;
  • design;
  • software;
  • databases;
  • databases;

are the property of AguAqui or their respective licensors and are protected under applicable intellectual property laws.

Any reproduction, distribution, modification, or use without prior written authorization is prohibited.

10. Links to Third-Party Services

The Application may contain links to third-party websites, platforms, or services.

AguAqui does not control and assumes no responsibility for the content, policies, or practices of such external services.

11. Data Protection

The processing of personal data carried out through the Application is governed by our:

By using the Application, the user acknowledges that they have read the AguAqui Privacy Policy.

12. Limitação de Responsabilidade

To the maximum extent permitted by applicable law, AguAqui shall not be liable for:

  • temporary interruptions of the Application;
  • technical failures;
  • device incompatibilities;
  • data loss;
  • delays in communications;
  • indirect damages or loss of profits;
  • misuse of the Application by the user or third parties.

Nothing in these Terms excludes legally recognized consumer rights under applicable Portuguese and European legislation.

13. Suspension and Termination

AguAqui may suspend or terminate access to the Application, temporarily or permanently, in case of:

  • violation of these Terms;
  • fraudulent activity;
  • abusive use of the platform;
  • legal non-compliance;
  • security risks.

14. Changes to the Terms

AguAqui may amend these Terms at any time.

Updated versions will be published on the website and/or in the Application, indicating the date of the last update.

Continued use of the Application after the publication of changes constitutes acceptance of the new Terms.

15. Governing Law and Jurisdiction

These Terms are governed by Portuguese law.

In the event of a dispute, the Portuguese courts shall have jurisdiction, without prejudice to the rights granted to consumers under applicable law.

The user may also resort to Consumer Alternative Dispute Resolution (ADR) entities, in accordance with applicable law.
