2. Purpose
These Terms apply to all orders placed via the website, mobile application, telephone, or other authorized channels, including:
- sale and delivery of bottled water in reusable water bottles;
- sale of beverages and fast-moving consumer goods (FMCG);
- sale of equipment and accessories;
- provision of home delivery services;
- subscription plans (where applicable);
- rental or temporary provision of equipment (where applicable).
3. Delivery Areas
AguAqui delivers within defined geographic areas, which are periodically updated on the official website.
The company reserves the right to:
- modify coverage areas;
- refuse deliveries outside the operating area;
- adjust service availability by region.
4. Orders
4.1 Orders may be placed via the website, mobile application, telephone, or other channels made available by AguAqui.
4.2 All orders are subject to:
- stock availability;
- payment confirmation;
- delivery address validation.
4.3 AguAqui may refuse or cancel orders in case of:
- obvious pricing error;
- suspected fraud;
- delivery impossibility;
- non-payment of previous invoices.
5. Prices and Payments
5.1 All prices include VAT at the applicable legal rate.
5.2 Accepted payment methods:
- credit/debit card;
- payment via terminal upon delivery;
- cash payment (cash on delivery);
- bank transfer (where applicable);
5.3 The minimum order value is 15€.
6. Delivery
6.1 AguAqui aims to complete deliveries within a period of até 1 dia útil, sendo este prazo indicativo e não garantido.
6.2 Deliveries are subject to:
- traffic conditions;
- logistical availability;
- safety conditions at the delivery location.
6.3 AguAqui reserves the right to refuse delivery if:
- the delivery location is unsafe for the courier;
- there is risk to persons or property;
- delivery cannot be carried out under reasonable conditions.
6.4 The customer’s presence is not mandatory at the time of delivery, unless otherwise specified.
7. FMCG Products (Fast-Moving Consumer Goods)
7.1 AguAqui sells products such as:
- water
- beverages
- milk and dairy products
- coffee
- snacks and food products
- household stationery items
- home accessories and equipment
7.2 These products are intended for final consumption and are not eligible for return after delivery, except in cases of defect or delivery error.
8. Right of Withdrawal
8.1 The customer may exercise the right of withdrawal within the legal period of 14 days, except in legally excluded cases.
8.2 Not eligible for return:
- food and perishable products after delivery;
- beverages and water after opening;
- sealed products after tampering with the packaging.
8.3 Non-food equipment sold on the website may be returned within the legal 14-day period, provided that:
- have not been used;
- are in their original condition;
- include packaging and accessories.
9. Reusable Water Bottles
9.1 The 18.9L reusable water bottles remain the exclusive property of AguAqui.
9.2 The customer undertakes to:
- keep the bottles in good condition;
- not damage them;
- not sell or transfer them to third parties;
- return them whenever requested or during future deliveries.
9.3 In case of loss, misplacement, or non-return, a fee of will be charged. €10 per bottle..
10. Equipment and Accessories
10.1 Equipment sold or provided by AguAqui must be used properly.
10.2 In case of sale:
- the equipment becomes the property of the customer.
10.3 In the case of equipment provided under subscription plans
- the equipment must be returned at the end of the contract;
- in case of damage, a fee of up to will be charged. 200€ por cooler danificado.
11. Subscriptions (where applicable)
11.1 AguAqui may offer subscription plans with periodic delivery of products.
11.2 The specific terms of each plan will be presented at the time of subscription.
11.3 The customer may cancel in accordance with the conditions of the applicable plan.
12. Customer Responsibility
The customer undertakes to:
- provide accurate data;
- ensure accessibility of the delivery location;
- use products and equipment correctly;
- not use the products improperly or for unauthorized commercial purposes.
13. Limitation of Liability
AguAqui shall not be liable for:
- delays caused by external factors;
- misuse of the products;
- indirect damages or loss of profit;
- inability to deliver due to safety or access reasons.
Nothing in these Terms limits the consumer’s statutory rights under Portuguese and European law.
14. Cancellations
14.1 Orders may be cancelled before they are dispatched.
14.2 After dispatch or once the order is out for delivery, cancellations are not accepted.
15. Amendments
AguAqui may update these Terms at any time, with the most recent version always published on the website.
16. Governing Law
These Terms are governed by Portuguese law.
In the event of a dispute, the jurisdiction of the Portuguese courts shall apply, without prejudice to the consumer’s rights.
* In case of discrepancy between the Portuguese and English versions, the Portuguese version shall prevail
